PLAYER’S RELEASE OF LIABILITY, ASSUMPTION OF RISK & INFORMED CONSENT AGREEMENT
In consideration of being allowed to participate in any way and at any time in an event or activity, including sporting events, by Bay Area Adult Soccer League or its related groups, the undersigned:
1. Acknowledges, appreciates, agrees, and fully understands the risk of serious injury exists related to participating in any BAY AREA ADULT SOCCER LEAGUE events, even though particular rules, equipment, and personal discipline may reduce this risk.
2. Acknowledges, appreciates, agrees, and fully understands that:
- The significant risk of injury, including the potential for permanent paralysis or death and severe social and economic losses, might result not only from my own action, inactions, or negligence, but the actions, inactions, or negligence of others from the activities, the rules of play, or the condition of the premises or of any equipment used or involved in this program; and
- There exists the possibility of other risks not known to me or BAY AREA ADULT SOCCER LEAGUE and not reasonably foreseeable at this time.
3. Agrees that prior to participating, I will inspect the facilities and equipment to be used, and if I believe anything is unsafe, will immediately advise the event organizers of such condition(s) and refuse to participate. I acknowledge, appreciate, agree, and fully understand that participation in any BAY AREA ADULT SOCCER LEAGUE events is voluntary, and I am in no way required to participate in any BAY AREA ADULT SOCCER LEAGUE events if I believe that my safety or well-being may be at risk.
4. Agrees to comply with the stated and customary terms and conditions for participation.
I, for myself and on behalf of my heirs, assigns, estate, personal representatives, and next of kin, HEREBY RELEASE, WAIVE, INDEMNIFY, DISCHARGE, COVENANT, AND HOLD HARMLESS BAY AREA ADULT SOCCER LEAGUE, its organizers, directors, commissioners, referees, officers, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, related groups and affiliated organizations, and owners and lessors of facilities used to conduct the event ("RELEASEES"), from any and all liability with respect to any and all claims, demands, losses, or damages on account of disability or injury, including death, pandemics, COVID-19, or damage to property, caused or alleged to be caused, in whole or in part, by the negligence of BAY AREA ADULT SOCCER LEAGUE or the RELEASEES enumerated above or otherwise, to the fullest extent permitted by law.
FORCE MAJEURE
I, for myself and on behalf of my heirs, assigns, estate, personal representatives, and next of kin, HEREBY RELEASE, WAIVE, INDEMNIFY, DISCHARGE, COVENANT, AND HOLD HARMLESS BAY AREA ADULT SOCCER LEAGUE and the RELEASEES from any and all liability with respect to any and all claims, demands, losses, or damages on account of infection, disability, or injury arising from any failure or delay in performing an obligation under this Agreement that is due to any of the following causes: acts of God, accidents, riots, war, terrorist acts, epidemics, pandemics, quarantine, civil commotion, breakdown of communication, natural catastrophes, governmental acts or omissions, changes in laws or regulations, national strikes, fires, explosions, bad or unsafe weather, fan/spectator behavior, or uninvited guests.
I agree to immediately inform BAY AREA ADULT SOCCER LEAGUE in writing at info@baasl.org or via text message to (510) 900-9559 if I become or have been diagnosed with COVID-19 or have a suspected diagnosis of COVID-19. The email subject line must include "COVID EXPOSURE ALERT." If I have been diagnosed with COVID-19 or have a suspected diagnosis of COVID-19, I agree to quarantine from all BAY AREA ADULT SOCCER LEAGUE events for 2 weeks or until I have received a negative COVID test result.
After being assigned to a team, I agree and consent that BAY AREA ADULT SOCCER LEAGUE and the RELEASEES may cancel, without issuing a partial or full refund or credit, any and all games at any time due to acts of God, accidents, riots, war, terrorist acts, epidemics, pandemics, quarantine, civil commotion, breakdown of communication, natural catastrophes, governmental acts or omissions, changes in laws or regulations, national strikes, fires, explosions, bad or unsafe weather, fan/spectator behavior, or uninvited guests.
I agree and consent that no refunds or credits will be issued by BAY AREA ADULT SOCCER LEAGUE as soon as I am assigned to a team, whether I voluntarily or involuntarily quit the team, even if I have not participated in any BAY AREA ADULT SOCCER LEAGUE games. I acknowledge that any fees paid to BAY AREA ADULT SOCCER LEAGUE are for the purposes of being assigned to a team. With regard to individual player and/or team registration fees, I agree and consent that BAY AREA ADULT SOCCER LEAGUE and the RELEASEES may cancel any and all games at any time, without issuing a credit or partial or full refund, due to acts of God, accidents, riots, war, terrorist acts, epidemics, pandemics, quarantine, civil commotion, breakdown of communication, natural catastrophes, governmental acts or omissions, changes in laws or regulations, national strikes, fires, explosions, bad or unsafe weather, fan/spectator behavior, or uninvited guests.
Whenever possible, each provision, term, and covenant of this Agreement will be interpreted in a manner to be effective and valid. If any provision, term, or covenant of this Agreement is held to be prohibited or invalid by a court of competent jurisdiction, then such provision, term, or covenant will be ineffective only to the extent of such prohibition or invalidity, without invalidating or affecting in any manner whatsoever the remainder of such provision, term, or covenant or the remaining provisions, terms, or covenants of this Agreement.
In the event of any dispute between the parties which arises under this Agreement, such dispute shall be settled by arbitration, and not by a lawsuit or resort to court process except as California law provides for judicial review of arbitration proceedings. A list of arbitrators shall be presented to the Claimant and Respondent from which one will be chosen using the applicable rules. The hearing shall be conducted in the County of Alameda, California, unless both parties consent to a different location. The decision of the arbitrator shall be final and binding upon all parties. Each party shall be responsible for its own attorney’s fees and its share of the arbitration fees. In the event a party fails to proceed with arbitration or fails to comply with the arbitrator's award, the other party is entitled to costs of suit, including reasonable attorney’s fees for having to compel arbitration or enforce the award. Any questions involving contract interpretation shall use the laws of California. An arbitrator's decision may be entered in any jurisdiction in which the party has assets in order to collect any amounts due hereunder.
I, for myself and on behalf of my heirs, assigns, estate, personal representatives, and next of kin, assume all the foregoing risks and accept personal responsibility for the damages following such injury, permanent disability, or death. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF BAY AREA ADULT SOCCER LEAGUE AND THE RELEASEES, and assume full responsibility for my participation.
This agreement may not be altered, amended, changed, modified, waived, or terminated in any respect or particular unless it is in writing signed by the parties to this agreement.
PHOTO & IMAGE RELEASE
I give my consent to have my picture, image, and name printed in any BAY AREA ADULT SOCCER LEAGUE program, publication, or video.
LOSS OF PERSONAL POSSESSIONS
I assume the risk of the personal possessions that I bring to all BAY AREA ADULT SOCCER LEAGUE events, or its related groups' events. I agree to release, waive, indemnify, discharge, and hold harmless BAY AREA ADULT SOCCER LEAGUE and the RELEASEES for any lost items or damage to property. BAY AREA ADULT SOCCER LEAGUE does not have its own lost and found, but players are advised to contact the League to inquire if lost items have been reported. Players are advised to contact facilities hosting BAY AREA ADULT SOCCER LEAGUE events directly to inquire about lost and found items.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT; FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS ON MY BEHALF (AND THE MINOR’S BEHALF, IF APPLICABLE) AND THAT OF OTHERS ON MY BEHALF (INCLUDING HEIRS, ASSIGNS, PERSONAL REPRESENTATIVES, AND NEXT OF KIN) BY SIGNING IT; SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, FULLY AWARE OF THE RISKS AND MY RELEASE AND WAIVER OF ANY CLAIM AGAINST BAY AREA ADULT SOCCER LEAGUE AND THE RELEASEES.

ACUERDO DE LIBERACIÓN DE RESPONSABILIDAD Y ASUNCIÓN DE RIESGOS
En consideración a quien se le permita participar de cualquier manera, y a cualquier momento, durante un evento o actividad, incluidos eventos deportivos, por BAY AREA ADULT SOCCER LEAGUE o sus grupos relacionados, el abajo firmante afirma que:
1. Reconoce que aunque hayan reglas particulares, existe el riesgo de lesiones graves, aunque el equipo y la disciplina personal pueden reducir este riesgo.
2. Reconoce que existe riesgo significativo de lesiones, inclusive la potencial de parálisis permanente y/o la muerte, y graves pérdidas sociales y económicas que puedan resultar no solo de sus propias acciones, inacciones o negligencia, sino también de las acciones, inacciones o negligencia de otras personas o por medio de las actividades, las reglas del juego o las condiciones de las instalaciones o del equipaje utilizado durante los programas. Además, pueden haber otros riesgos que no conocemos o que no son previsibles en este momento.
3. Está de acuerdo en que antes de participar, inspeccionaré las instalaciones y el equipo/equipaje que se utilizará y, si considero que algo no está seguro, informaré de inmediato a los organizadores del evento de tales condiciones y me negaré a participar. Reconozco, aprecio, estoy de acuerdo y entiendo completamente que la participación en cualquier evento de BAY AREA ADULT SOCCER LEAGUE es voluntaria y de ninguna manera estoy obligado a participar en ningún evento BAY AREA ADULT SOCCER LEAGUE si creo que mi seguridad o bienestar pueden estar en riesgo.
4. Acuerda cumplir con los términos y las condiciones para la participación establecidos y habituales.
5. Yo, por mí mismo y en nombre de mis herederos, cesionarios, sucesiones, representantes personales y parientes más cercanos, LIBERAMOS, RENUNCIAMOS, INDEMNIZO, DESCARGO, PACTO Y MANTENGO INOFENSIVA Y SOSTENGO SIN LIGA BAY AREA ADULT SOCCER LEAGUE, sus organizadores, directores, comisionados, árbitros, oficiales, funcionarios, agentes y/o empleados, otros participantes, agencias patrocinadoras, patrocinadores, anunciantes, grupos relacionados y organizaciones afiliadas, y propietarios y arrendadores de instalaciones utilizadas para llevar a cabo el evento (“LIBERADOS”), de cualquier y toda responsabilidad con respecto a todas y cada una de las reclamaciones, demandas, pérdidas o daños a causa de discapacidad o lesión, epidemias, pandemias, COVID-19, inclusive la muerte o daños a la propiedad, causados o presuntamente causados, en su totalidad o en parte, por la negligencia de BAY AREA ADULT SOCCER LEAGUE o sus relacionados "liberados" enumerados anteriormente o de otro modo, en la medida máxima permitida por la ley.
6. FUERZA MAYOR. Yo, por mí mismo y en nombre de mis herederos, cesionarios, patrimonio, representantes personales y familiares más cercanos, POR LA PRESENTE LIBERAMOS, RENUNCIAMOS, INDEMNIZO, DESCARGO, PACTO Y MANTENGO BAY AREA ADULT SOCCER LEAGUE Y LOS EXONERADOS/LIBERADOS de toda responsabilidad con respecto a todas y cada una de las reclamaciones, demandas, pérdidas o daños a causa de infección, discapacidad o lesión que surja de cualquier incumplimiento o demora en el cumplimiento de una obligación en virtud de este Acuerdo que se deba a cualquiera de las siguientes causas: casos fortuitos, accidentes, disturbios, guerras, actos terroristas, epidemias, pandemias, cuarentena, conmoción civil, interrupción de la comunicación, catástrofes naturales, actos u omisiones gubernamentales, cambios en las leyes o regulaciones, huelgas nacionales, incendios, explosiones, mal tiempo o inseguridad, comportamiento de los fanáticos/espectadores o invitados no invitados.
7. Acepto informar inmediatamente a BAY AREA ADULT SOCCER LEAGUE por escrito a info@baasl.org o por mensaje de texto al (510) 900-9559 si me diagnostican o me han diagnosticado COVID-19 o si tengo un diagnóstico sospechoso de COVID-19. La línea de asunto del correo electrónico debe incluir "ALERTA DE EXPOSICIÓN A COVID". Si me han diagnosticado COVID-19 o tengo un diagnóstico sospechoso de COVID-19, acepto poner en cuarentena todos los eventos de BAY AREA ADULT SOCCER LEAGUE durante 2 semanas o hasta que haya recibido un resultado negativo en la prueba de COVID.
8. Después de ser asignado a un equipo, acepto y consiento que BAY AREA ADULT SOCCER LEAGUE y los LIBERADOS pueden cancelar, sin emitir un reembolso o crédito parcial o total, todos y cada uno de los juegos en cualquier momento debido a casos fortuitos, accidentes, disturbios, guerra, actos terroristas, epidemias, pandemias, cuarentena, conmoción civil, interrupción de la comunicación, catástrofes naturales, actos u omisiones gubernamentales, cambios en las leyes o regulaciones, huelgas nacionales, incendios, explosiones, mal tiempo o inseguridad, comportamiento de los fanáticos/espectadores o invitados no invitados. Estoy de acuerdo y doy mi consentimiento de que BAY AREA ADULT SOCCER LEAGUE no emitirá reembolsos ni créditos tan pronto como sea asignado a un equipo, ya sea que renuncie voluntaria o involuntariamente al equipo, incluso si no he participado en ningún juego de BAY AREA ADULT SOCCER LEAGUE. Reconozco que los honorarios pagados a BAY AREA ADULT SOCCER LEAGUE tienen el propósito de ser asignados a un equipo. Con respecto a las tarifas de registro de jugadores individuales y/o equipos, estoy de acuerdo y consiento que BAY AREA ADULT SOCCER LEAGUE y los LIBERADOS pueden cancelar todos y cada uno de los juegos en cualquier momento, sin emitir un crédito o reembolso parcial o total, debido a actos de Dios, accidentes, disturbios, guerra, actos terroristas, epidemias, pandemias, cuarentena, conmoción civil, interrupción de la comunicación, catástrofes naturales, actos u omisiones gubernamentales, cambios en las leyes o regulaciones, huelgas nacionales, incendios, explosiones, mal tiempo o inseguridad, comportamiento de los fanáticos/espectadores o invitados no invitados.
9. Siempre que sea posible, cada disposición, término y pacto de este Acuerdo se interpretará de manera efectiva y válida, pero si alguna disposición, término o pacto de este Acuerdo se considera prohibido o inválido por un tribunal de jurisdicción competente, entonces dicha disposición, término o pacto será ineficaz solo en la medida de dicha prohibición o invalidez, sin invalidar o afectar de ninguna manera el resto de dicha disposición, término o pacto o las disposiciones, términos o convenios restantes de este Acuerdo.
10. En caso de cualquier disputa entre las partes que surjan en virtud de este Acuerdo, dicha disputa se resolverá mediante arbitraje y no mediante una demanda o recurso a un proceso judicial, excepto cuando la ley de California disponga la revisión judicial de los procedimientos de arbitraje. Se presentará una lista de árbitros al Demandante y al Demandado, de los cuales se elegirá uno usando las reglas aplicables. La audiencia se llevará a cabo en el Condado de Alameda, California, a menos que ambas partes den su consentimiento para una ubicación diferente. La decisión del árbitro será final y vinculante para todas las Partes. Cada parte será responsable de los costos/honorarios de su propio abogado y su parte de los costos del arbitraje. En caso de que una parte no proceda con el arbitraje o no cumpla con el laudo del árbitro, la otra parte tiene derecho a los costos de la demanda, incluidos los costos razonables de abogados por tener que obligar/exigir el arbitraje o hacer cumplir el laudo. Cualquier pregunta relacionada con la interpretación del contrato deberá usar las leyes de California. La decisión de un árbitro se puede ingresar en cualquier jurisdicción en la que la parte tenga activos para cobrar cualquier monto adeudado en virtud del presente.
11. Yo, por mí mismo y en nombre de mis herederos, cesionarios, patrimonio, representantes personales y familiares más cercanos, asumo todos los riesgos anteriores y acepto la responsabilidad personal por los daños derivados de dicha lesión, discapacidad permanente o muerte. ASUMO CON CONOCIMIENTO Y LIBREMENTE TODOS DICHOS RIESGOS, tanto conocidos como desconocidos, INCLUSO SI SURGEN DE LA NEGLIGENCIA DE LOS LIBERADOS/BAY AREA ADULT SOCCER LEAGUE u otros, y asumo toda la responsabilidad por mi participación.
12. Este acuerdo no puede ser alterado, enmendado, cambiado, modificado, renunciado o terminado en ningún aspecto o en particular a menos que esté firmado por escrito por las partes de este acuerdo.
13. Publicación de fotos e imágenes: Doy mi consentimiento para que mi foto, imagen y nombre se impriman en cualquier programa, publicación o video de BAY AREA ADULT SOCCER LEAGUE.
14. Pérdida de posesiones personales: Asumo el riesgo de las pertenencias personales que llevo a todos los eventos de la BAY AREA ADULT SOCCER LEAGUE o eventos de sus grupos relacionados. Estoy de acuerdo en liberar, renunciar, indemnizar, despedir y eximir de responsabilidad a BAY AREA ADULT SOCCER LEAGUE y a los LIBERADOS, sus administradores o grupos relacionados por cualquier artículo perdido o daño a la propiedad. BAY AREA ADULT SOCCER LEAGUE no tiene su propio departamento de objetos perdidos, pero se recomienda a los jugadores que se comuniquen con la Liga para preguntar si se han reportado artículos perdidos. Se recomienda a los jugadores que se pongan en contacto directamente con las instalaciones que albergan los eventos de la BAY AREA ADULT SOCCER LEAGUE para consultar sobre artículos perdidos y encontrados.
HE LEÍDO ESTE ACUERDO DE LIBERACIÓN DE RESPONSABILIDAD Y ASUNCIÓN DE RIESGOS; ENTIENDO PLENAMENTE Y TOTALMENTE SUS TÉRMINOS, ENTIENDO QUE HE RENUNCIADO A DERECHOS SUSTANCIALES EN MI NOMBRE (Y EN NOMBRE DEL MENOR DE EDAD, SI ES APLICABLE) Y LOS DE OTROS EN MI NOMBRE (INCLUYENDO HEREDEROS, CESIONARIOS, REPRESENTANTES PERSONALES Y PARIENTES PRÓXIMOS) AL FIRMARLO; AL FIRMARLO LIBREMENTE Y VOLUNTARIAMENTE, SIN NINGÚN INDUCIMIENTO, TOTALMENTE CONSCIENTE DE LOS RIESGOS Y DE MI LIBERACIÓN Y RENUNCIA DE CUALQUIER RECLAMO CONTRA LA LIGA DE FÚTBOL DE ADULTOS DE BAY AREA Y LOS LIBERADOS.
Al completar y firmar a continuación, confirmo que he leído, entendido y aceptado todos los términos de este acuerdo.
